1. Acceptance of these Terms

These Terms of Service (the “Terms”) govern your access to and use of the website at basketsolana.xyz and app.basketsolana.xyz, including the waitlist and any interface it provides (together, the “Interface”), operated by the Basket team (“Basket”, “we”, “us”). By accessing or using the Interface, you agree to be bound by these Terms. If you do not agree, do not use the Interface.

2. The Interface, not the Protocol

The Interface is a website that displays information about, and facilitates interaction with, the Basket protocol — open-source smart contracts deployed on the Solana blockchain (the “Protocol”). The Protocol is public infrastructure: it runs autonomously on-chain, is not operated or controlled by us, and can be accessed by anyone without the Interface. Your interactions with the Protocol are executed by the Solana network, not by us.

We never take custody of your assets, hold your private keys, or execute transactions on your behalf. Every transaction requires your signature through a wallet you control.

3. Eligibility

You may use the Interface only if you are of legal age and capacity to enter into these Terms in your jurisdiction, and only where such use is lawful. You may not use the Interface if you are located in, or are a resident or national of, any jurisdiction where use of the Interface or the Protocol would be unlawful, or if you are subject to economic sanctions or listed on any sanctions-related list of prohibited or restricted parties.

4. No Financial, Legal, or Tax Advice

Nothing on the Interface constitutes financial, investment, legal, accounting, or tax advice, or a recommendation, solicitation, or offer to buy or sell any asset. All content is provided for informational purposes only. Basket index tokens are not shares, securities, deposits, or claims against any person. You are solely responsible for evaluating any interaction with the Protocol and for your own decisions.

5. Assumption of Risk

Digital assets and decentralized protocols are experimental and high-risk. By using the Interface you acknowledge and accept, among others: (a) smart contracts may contain bugs or vulnerabilities that could result in the partial or total loss of assets; (b) digital-asset prices are highly volatile, and the value of any index token or its components can go to zero; (c) oracle data, swap routing, and other third-party dependencies may fail, be delayed, or be manipulated; (d) blockchain transactions are irreversible; (e) laws applying to digital assets are uncertain and may change. You accept full responsibility for all risks of using the Interface and the Protocol, and you agree that you use them at your own risk.

6. Waitlist and Communications

If you join the waitlist, you consent to us storing your email address and using it to contact you about Basket — launch updates, early access, and closely related announcements. We will not sell your email address. You can request removal at any time by contacting us (see Section 13), and we will delete your address from the list.

7. Prohibited Uses

You agree not to use the Interface to: violate any law or regulation; circumvent sanctions or export controls; infringe the rights of others; attempt to exploit, disrupt, or gain unauthorized access to the Interface or the Protocol; introduce malicious code; scrape or overload the Interface; or misrepresent your identity or affiliation.

8. Intellectual Property

The Interface’s design, text, graphics, and branding are owned by us or our licensors. Open-source components of the Protocol and related software are licensed under their respective licenses. Except as permitted by those licenses, you may not copy, modify, or distribute Interface content without our permission.

9. Third-Party Services

The Interface may display data from, link to, or route through third-party services — including wallets, swap aggregators, oracles, RPC providers, and analytics. We do not control and are not responsible for third-party services, their availability, or their accuracy. Your use of them is governed by their own terms.

10. Disclaimers

THE INTERFACE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE INTERFACE OR THE PROTOCOL WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION DISPLAYED IS ACCURATE, COMPLETE, OR CURRENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL BASKET OR ITS CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR DIGITAL ASSETS, ARISING OUT OF OR RELATING TO YOUR USE OF THE INTERFACE OR THE PROTOCOL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE INTERFACE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

12. Indemnification

You agree to indemnify and hold harmless Basket and its contributors from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Interface or the Protocol, your violation of these Terms, or your violation of any law or the rights of any third party.

13. Changes, Termination, and Contact

We may update these Terms at any time by posting a revised version at basketsolana.xyz/terms; continued use of the Interface after changes take effect constitutes acceptance. We may suspend or discontinue the Interface at any time — the Protocol remains accessible on-chain regardless. Questions about these Terms can be sent to us via X at x.com/Basket_on_sol.

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms are the entire agreement between you and us regarding the Interface.
